WAIVER OF LIABILITY AND RELEASE FORM

Release of Liability, Waiver of Claims, Assumption of Risks.

By signing this document, you will waive certain legal rights, including the right to sue in the event of injury. Please read carefully.

Assumption of Risks

I/We understand that the training, programs, and events held by Jimmy Nguyen under Nguyen Martial Arts may expose me to inherent risks, including accidents, injury, illness, or even death. I/We assume all risks associated with participation, including falls, bruising, contact with other participants, and effects of the weather, including high heat and humidity.

I/We acknowledge my responsibility to communicate any physical or psychological concerns that might conflict with participation. I/We confirm that I am physically fit and mentally capable of performing the activities I choose to participate in.

I, fully cognizant of the inherent risks entailed in martial arts, including but not limited to the potential for severe injury or fatality, willingly accept these risks. I hereby assume complete responsibility for my voluntary engagement in said classes and activities.

Release of Liability, Waiver of Claims

In consideration of my participation, I/We, for myself and anyone entitled to act on my behalf, agree to HOLD HARMLESS, WAIVE, AND RELEASE Jimmy Nguyen and Nguyen Martial Arts, its officers, agents, employees, organizers, representatives, and successors from any responsibility, liabilities, demands, or claims arising out of my participation in Nguyen Martial Arts training, programs, and/or events.

I hereby absolve and release Nguyen Martial Arts, its proprietors, employees, agents, and affiliates from any and all liability, claims, demands, actions, or causes of action, whether direct or indirect, arising from any loss, damage, or injury, including death, incurred during my participation in martial arts classes and activities.

Medical Emergencies

In the event of a medical emergency, I authorize Nguyen Martial Arts and its representatives to seek medical treatment for me/my child at their discretion. I understand that I am responsible for any medical expenses incurred.

Indemnification

I agree to indemnify and hold harmless Nguyen Martial Arts, its officers, agents, employees, organizers, representatives, and successors against any and all claims, suits, actions, damages, or losses, including attorney's fees, arising out of or resulting from my participation in Nguyen Martial Arts activities.

Photography and Video Release

I grant Nguyen Martial Arts the right to use photographs and videos taken during training and events for promotional purposes. I understand that these images may be used in various media, including print and online publications.

Compliance with Health Regulations

I agree to comply with all health and safety regulations and guidelines, including those related to communicable diseases such as COVID-19, as set forth by Nguyen Martial Arts and public health authorities.

Acknowledgment of Understanding

I acknowledge that I have read and fully understand the terms of this agreement and that I am voluntarily giving up substantial legal rights, including the right to sue.

Children

As a parent or legal guardian of a child under 18 years of age participating in Nguyen Martial Arts activities, I affirm that I have thoroughly read, comprehended, and consented to the terms delineated in this waiver. I assume full responsibility for ensuring my child's adherence to all safety regulations and rules of Nguyen Martial Arts, thereby assuming all associated risks and responsibilities.

If the participant is under 18 years of age, I represent that I have the legal capacity to act on behalf of the minor named herein.

Membership Policy

Cancel anytime with 30 days' notice. We do not provide refunds and do not require long-term contracts. Services are billed monthly and include GST on a prorated basis.

Membership Cancellation

I acknowledge the imperative of furnishing a written notice of membership cancellation to Nguyen Martial Arts, at minimum 30 days prior to the desired cessation date. Cancellations may be effectuated by contacting us at 604-440-9246 via text during standard business hours or by means of electronic mail at nguyenmartialarts@gmail.com. Non-compliance with this stipulated notice period may incur continued membership fees. Late payments will incur a late fee of $10 every week, up to a maximum of $50. I am cognizant that cancellations are governed by the terms elucidated in our cancellation policy, permitting cancellation at any time with a mere 30 days' notice. No contractual obligations are mandated, and all services are subject to applicable GST and billed on a monthly basis.

Governing Law

This waiver and release shall be interpreted and enforced in accordance with the laws of the province of British Columbia, ensuring absolute legal clarity and adherence.

I am 18 years of age or older and competent to sign this contract in my own name. I have read and understood this form prior to signing it and am aware that by signing this consent, I am giving permission to Nguyen Martial Arts to use my image for the stated purposes. Consent may be withdrawn at any time without retroactive effect, except where permitted or required by law.
